Please read these Terms carefully. They set out the rules for using the app, whether you are here to buy, to sell, or to run an event.
These Terms of Service ("Terms") govern your use of the EveryFinder app and every page and service we run alongside it (together, the "Platform"). By creating an account, signing in, browsing listings, buying a ticket or a product, or publishing an event, a shop or a product, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which form part of them.
If you do not agree with any part of these Terms, please do not use the Platform.
EveryFinder runs the Platform as a marketplace. We connect event organizers, shop owners and buyers. Unless we say otherwise in writing, we are not the seller of a product, the organizer of an event, or a party to the contract between a buyer and a seller.
To use the Platform you must:
We may suspend, restrict or close any account that gives us false information, is used for fraud or abuse, or repeatedly breaches these Terms. If you are acting for a business, you confirm you have authority to bind that business to these Terms.
If you publish an event you are the organizer, and you are solely responsible for that event and for everyone who buys a ticket to it.
Before an event can be published you must tick the box confirming you have read and accepted these Terms and the Privacy Policy. We record the date and time of that acceptance against the event.
If you open a shop or upload products you are the seller, and you are solely responsible for what you list and what you sell.
We may hide, edit or delete any shop, product, review or advert that breaches these Terms, and we may suspend selling privileges without notice where the breach is serious.
Payments are processed through our payment partners, currently M-Pesa. When you pay, you authorise the exact amount shown on the confirmation prompt. All prices on the Platform are in Kenyan Shillings (KES).
Ticket sales carry a platform commission of 5% of the sale amount. We deduct it automatically at the moment the sale completes and credit the remaining net amount to the organizer's event balance. The rate that applies is the rate in force when the sale completes, and it is recorded against that purchase so it never changes afterwards.
Organizers withdraw their available balance to the payout details saved on the event. Withdrawal requests are reviewed and processed by us, and may take time to reflect.
Product orders may require a deposit at checkout, with the balance payable to the shop on delivery or collection. The deposit percentage and the balance due are shown to you before you pay.
Shop adverts are prepaid. The advert starts once payment completes and runs for the number of days in the plan you bought.
The Platform itself — the EveryFinder name, our logo, the app, its design, code and everything we create for it — belongs to us or to our licensors. You may not copy, modify, reverse engineer, scrape, resell or build derivative works from it without our written permission.
You keep ownership of what you upload: shop logos, product photos, event posters, descriptions and reviews ("Your Content"). By uploading Your Content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, resize, display and promote it on the Platform and in our marketing of the Platform, for as long as you keep it posted and for a reasonable period afterwards in backups and caches.
You confirm that Your Content is yours to upload and does not infringe anyone else’s rights. If you believe content on the Platform infringes your rights, contact us with the details and we will review it and, where appropriate, remove it.
The Platform is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, or that listings, prices, stock levels or event details posted by other users are accurate.
We are a marketplace, not the seller or the organizer. We are not responsible for the quality, safety, legality or delivery of any product, for whether an event takes place or meets your expectations, or for the conduct of any user, online or in person.
To the maximum extent the law allows, EveryFinder, its owners, staff and partners will not be liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or opportunity, arising from your use of the Platform.
Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid through the Platform for the specific transaction the claim relates to, less any commission and fees already deducted.
Nothing in these Terms limits liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded under the laws of the Republic of Kenya.
If something goes wrong, start with the other party. Buyers should contact the shop or organizer using the contact details on the listing, and sellers and organizers should reply promptly and in good faith.
If that does not settle it, raise it with us. Send our support team your order, ticket or M-Pesa reference and a clear description of the problem, and allow us a reasonable period — normally up to 14 days — to investigate.
We will look at the evidence from both sides and may mediate, apply our Refund Policy, hold or release a payout, or remove a listing. That decision is an administrative one about how the Platform is used and does not stop you exercising your legal rights.
If a dispute still cannot be resolved, you and the other party agree to attempt settlement through negotiation and then mediation before starting court proceedings.
These Terms, and any dispute or claim arising out of them or their subject matter, are governed by the laws of the Republic of Kenya, without regard to conflict of law rules.
The courts having jurisdiction under the laws of the Republic of Kenya have exclusive jurisdiction over any dispute, except that we may seek injunctive relief in any competent court to protect our intellectual property or the security of the Platform.
We may update these Terms as the Platform grows or as the law changes. The current version always lives here in the app, and the date at the top of this page tells you when it last changed.
If a change materially affects your rights, we will give you notice in the app, by email or by push notification before it takes effect.
Continuing to use the Platform after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Platform and close your account.
